The board also learned it retains broad discretion over local fines of $100 to $300, including the ability to continue a matter without a finding or lift a suspension entirely, though the agents cautioned that consistency across cases is essential to avoid conflicting precedents. One board member raised a question about a specific second-offense sale-to-minor case in which the store owner reportedly claimed the inspector was visible in the parking lot at the time of the sale; agent Joan reviewed the inspection file on the spot, found no notation of any such interaction, and said she would follow up directly with inspector Rick to get a statement before any appeal hearing.
